DAG Hosts over 200 at Dallas Symposium
DAG was pleased to host over 200 attendees from 13 Dallas-area servicers at its Real Estate Default Symposium in the Dallas area this June. Sessions for staff and managers were offered on foreclosure and bankruptcy basics, plus in-depth discussions of mediation, loss mitigation, recent litigation and more. The training was presented by the seasoned partners of DAG member firms. Over 150 Attend DAG Symposium in Jacksonville
DAG was pleased to host over 150 attendees from local servicers at its Real Estate Default Symposium in Jacksonville in May. Sessions for staff and managers were offered on foreclosure and bankruptcy basics, plus in-depth discussions of mediation, loss mitigation, recent litigation and more. The training was presented by the seasoned partners of DAG member firms, and attendees received resource materials to take back to their offices for reference.

On May 4, 2010, Berry F. Laws III of member firm Martin, Leigh, Laws & Fritzlen, PC (MO, KS) participated as a panelist at the Federal Reserve Bank of Kansas City . Default Attorney Group Announces Organizational Change for 2010

December 23, 2009: Default Attorney Group (DAG), a nationwide association of legal professionals serving mortgage lenders and servicers, announces an organizational change for 2010. Since its formation in 2007, DAG has been privileged to have Kathleen Guerrette-Mitchell serve as the organization’s Executive Director, providing leadership in establishing the organization’s structure, mission and vision. With the organization now well founded, Mitchell will leave her post to more fully pursue her consulting practice, kgm consultants, llc.

Pite Duncan Summarizes Bankruptcy Rules Changes Effective Dec. 1, 2009

Significant changes to the Federal Rules of Bankruptcy Procedure ("Bankruptcy Rules") became effective December 1, 2009. The most notable amendments to the Bankruptcy Rules involve the computation of time under the Bankruptcy Rules and the increased stay period on orders granting motions for relief from the automatic stay. The federal rules of calculating time periods were changed to be simpler, clearer, and consistent, especially with regard to the handling of holidays and weekends. At the same time, Bankruptcy Rule 4001 was amended to extend the stay after the entry of order granting a motion for relief from automatic stay from 10-days to 14-days.

New Year, New Rules: What Servicers Need to Know about RESPA Changes

If you originate and service loans, strict compliance with RESPA is required as of January 1, 2010. Servicers also need to be aware of the changes under RESPA, so that they can adequately address borrower's questions and concerns, particularly if they receive a Qualified Written Request. Servicers should also be careful when they service loans that may have RESPA violations, as a borrower will likely file an affirmative defense or request a set off. While specific defenses can be raised on behalf of servicers, it is one additional hurdle to complete a foreclosure.
